Terms & conditions

1. In general
The customer accepts the following terms and conditions for the entire business relationship. The terms and conditions of AIM Produkte AG are in force exclusively. Any questions or objections in connection with these terms and conditions, or the contracts on which they were based on, can be brought forward in writing to AIM Produkte AG, Rebenstrasse 30, 5426 Lengnau or per e-mail to INFO@WHIPFLIPP.CH.

2. Registration
Usage of the e-shop requires registration. The customer has to register at whipflipp.ch and provide the required data completely and correctly.

3. Supply and contract of purchase
The on-line representation of our assortment is not a binding contract offer. By sending an order to us the customer enters a binding tender. AIM Produkte AG holds the right of refusal or acceptance of the customers order. The customer will receive notification per e-mail to confirm the entry of the order. Should the on-line details to the assortment be incorrect, AIM Produkte will submit a counter-offer, which the customer may accept or decline. Should AIM Produkte AG refuse the order, the customer will be informed.

4. Sale conditions
The prices of AIM Produkte AG correspond with the offers of the e-shop.

5. Pay conditions
Payment takes place a) by invoice within ten days of receipt of the product (for Swiss customers only), b) in advance (for Swiss customers only), or c) cash on delivery. The payment due is net and without any reduction at the point of contract conclusion. Should the customer delay the payment fully or partially, the sum owed will be due immediately.

6. Terms and conditions of the delivery
Should the goods ordered by the customer not be available, AIM Produkte AG has the right to terminate the contract. The customer will be informed immediately of the unavailability of the product and any payment forwarded by the customer will be reimbursed without delay.
In some cases AIM Produkte AG is entitled to extend the term of delivery. The customer will be informed of this immediately.
Deliverable goods are only the goods shown in the current online-catalogue of AIM Produkte AG.

7. Mailing (shipment)
The prices of the products in the e-shop incl. VAT; however postage is excluded in those prices. In general, the mailing is done through standard parcel post.

8. Exchange / objections
Faults like damaged goods, inadequate quantity, breakage, etc. canonly be taken into consideration if AIM PRODUKTE AG has been notified within three days of the of the product being delivered. The customer should therefore check the goods at the point of delivery and in case of damage, the original delivery note will need to be signed and dated by the delivery service (i.e. postman/woman). Should the three day period elapse without notification, the delivery will be deemed accepted by the recipient. Goods returned without prior agreement are deemed inadmissible and will not be taken back.

9. Property reservation
The delivered goods are the property of AIM Produkte AG until all requirements, which result from the business relation, have been settled by the customer.

10. Changes
AIM Produkte AG has the liberty to change the terms and conditions at any time. This may also involve improvements and the addition of new outputs of whipflipp.ch. It is the customer’s responsibility to check the date of the terms and conditions and look for alterations.

11. Data protection / information technology
AIM Produkte AG only requests the necessary data for the online offers. The data is used by AIM Produkte AG for the sole purpose of entering a buying contract and customer administration. Saving the data is in unison with the regulations of the Swiss data protection law.

12. Limited liability
In negligent violation of obligation AIM Produkte AG will limit the liability to the refund of the price of purchase.
This limited liability does not involve the customer claim of product liability. The risk of transport is in any case chargeable to the buyer.

13. Nullity and ineffectiveness
Should one or more regulations of these terms and conditions be or become ineffective, that has no bearing on the effectiveness of the other regulations within these terms and conditions.

14. Legal domicile
The legal venue is located in Zurzach AG, Switzerland. The Swiss law is in force.
